NOTICE OF APPEAL OF ENERGY COMMISSION'S
DENIAL OF CONFIDENTIALITY



BACKGROUND

Electricity Supply (06-IEP-1J)

On February 8, 2007, Southern California Edison (SCE) filed Electricity Resource Data Submittal forms S-1, S-2, and S-5 with the Energy Resources Conservation and Development Commission of the State of California (Energy Commission) for use in the 2007 Integrated Energy Policy Report (IEPR) proceeding. (06-IEP-1J.) As part of that filing, SCE sought a designation of confidentiality.

On March 12, 2007, the Energy Commission's Executive Director issued a decision granting, in part, and denying, in part, SCE's application for confidentiality. On March 27, 2007, SCE filed an appeal of that decision. Accordingly, the Energy Commission scheduled SCE's appeal for its April 25, 2007, Business Meeting. On April 11, 2007, a conference call was held between representatives of SCE and Energy Commission staff where additional information was provided regarding confidentiality. On April 19, 2007, SCE requested a stay of its appeal, which the Executive Director granted on April 23, 2007. On April 20, 2007, the Executive Director issued an amended decision upholding, in part, and modifying, in part, his initial decision concerning 06-IEP-1J. Accordingly, the Energy Commission has scheduled SCE's appeal of this issue at its Business Meeting noticed below.

Demand Forecast (06-IEP-1I)

On February 6, 2007, SCE filed Electricity Demand Forecast forms 1.2, 1.3, 1.4, 1.5 and 1.6(a) with the Energy Commission for use in the 2007 IEPR proceeding. (06-IEP-1I.) As part of that filing, SCE sought a designation of confidentiality.

On March 12, 2007, the Energy Commission's Executive Director issued a decision granting, in part, and denying, in part, SCE's application for confidentiality. Retail Electricity Price (06-IEP-1H)

On March 16, 2007, SCE filed Retail Electricity Price Data with the Energy Commission for use in the 2007 IEPR proceeding. (06-IEP-1H.) As part of that filing, SCE sought a designation of confidentiality for certain data. On April 16, 2007, the Energy Commission's Executive Director issued a decision granting, in part, and denying, in part, SCE's application for confidentiality. On April 30, 2007, SCE filed an appeal of that decision. Accordingly, the Energy Commission has scheduled SCE's appeal of this issue at its Business Meeting noticed below.

NOTICE OF APPEAL

The Energy Commission will consider SCE's appeals denying their applications for confidentiality pursuant to California Code of Regulations, title 20, section 2505(a)(3), at the following Energy Commission Business Meeting:

At this event, SCE and other interested parties will have an opportunity to present a summary of their respective positions regarding the Executive Director's decisions denying SCE's applications for confidentiality and describe the types of evidence necessary to address unresolved factual issues. At the end of the presentations (and following questions from the Commissioners and public comments), the Energy Commission will, if necessary, schedule an evidentiary hearing to be held at the June 20 or July 3 Business Meeting. Be advised that the discussion of these appeals at this Business Meeting will be similar to a pre-hearing conference, and testimony will not be heard.

PUBLIC PARTICIPATION

Members of the public and interested governmental agencies are invited to attend this Business Meeting, and may offer public comment upon the matters discussed. These public comments will be entered into the record, and the Energy Commission may rely on them to supplement or explain its decision in this matter. Public comments by themselves, however, are not sufficient to support a finding of fact or a decision on an issue.

Interested persons and governmental agencies are encouraged to attend. Public comment on this matter should be submitted, in writing, to the Energy Commission's Docket Unit, located at 1516 Ninth Street, MS-4, Sacramento, California, 95814-5512, no later than 5:00 p.m. on June 1, 2007. Identify these comments with "Docket No. 06-IEP-01J."
