The California Energy Commission approved this project's Application For Certification on October 11, 2006. The Commission monitors the power plant's construction, operation and eventual decommissioning through a compliance proceeding.

GENERAL DESCRIPTION OF PROJECT

On December 30, 2003, Calpine filed an Application for Certification of the Los Esteros 2 Critical Energy Facility. This AFC has two parts or phases.

Phase 1 of "Los Esteros 2" sought a license (recertification) for continued operation of the Los Esteros 1 Critical Energy Facility located in the City of San Jose. Los Esteros 1 was approved by the Commission on July 2, 2002, as a "peaker" power plant with a limited three-year period of operation. Phase 1 of Docket 03-AFC-2 (Los Esteros 2) requested recertification. That recertification was approved on March 16, 2005. Because this recertification was filed under Docket 03-AFC-2 and was licensed, that first phase of the project is now handled under a compliance proceeding, 03-AFC-2C.

Phase 2 of "Los Esteros 2" is a proposed 180 megawatt natural gas-fired peaking power plant consisting of four simple-cycle combustion turbine generators and associated equipment. it would be built at the same location as Los Esteros 1. This phase also seek a license for conversion of the facility to a combined-cycle operation. This licensing proceeding is under Docket 03-AFC-2.


Energy Commission Facility Certification Process

The California Energy Commission is the lead agency (for licensing thermal power plants 50 megawatts and larger) under the California Environmental Quality Act (CEQA) and has a certified regulatory program under CEQA. Under its certified program, the Energy Commission is exempt from having to prepare an environmental impact report. Its certified program, however, does require environmental analysis of the project, including an analysis of alternatives and mitigation measures to minimize any significant adverse effect the project may have on the environment.
