NOTICE OF APPEAL OF ENERGY COMMISSION'S
DENIAL OF CONFIDENTIALITY
On April 5, 2007, Southern California Edison (SCE) filed Nuclear Power Plant-Related Data with the Energy Resources Conservation and Development Commission of the State of California (Energy Commission) for use in the 2007 Integrated Energy Policy Report (IEPR) proceeding. (06-IEP-1N.) As part of that filing, SCE sought a designation of confidentiality for all or portions of its response to Data Requests.
On May 4, 2007, the Energy Commission's Executive Director issued a decision granting, in part, and denying, in part, SCE's application for confidentiality. On May 18, 2007, SCE filed an appeal of that decision. Accordingly, the Energy Commission has scheduled SCE's appeal of this issue at its Business Meeting noticed below.
NOTICE OF APPEAL
The Energy Commission will consider SCE's appeals, including its appeal denying confidentiality for nuclear data, pursuant to California Code of Regulations, title 20, section 2505(a)(3), at the following Energy Commission Business Meeting:

At this event, SCE and other interested parties will have an opportunity to present a summary of their respective positions regarding the Executive Director's decisions denying SCE's applications for confidentiality and describe the types of evidence necessary to address unresolved factual issues. At the end of the presentations (and following questions from the Commissioners and public comments), the Energy Commission will, if necessary, schedule an evidentiary hearing to be held at the June 20, July 3 or July 18, 2007 Business Meeting. Be advised that the discussion of these appeals at this Business Meeting will be similar to a pre-hearing conference, and testimony will not be heard.
Members of the public and interested governmental agencies are invited to attend this Business Meeting, and may offer public comment upon the matters discussed. These public comments will be entered into the record, and the Energy Commission may rely on them to supplement or explain its decision in this matter. Public comments by themselves, however, are not sufficient to support a finding of fact or a decision on an issue.
Interested persons and governmental agencies are encouraged to attend. Public comment on this matter should be submitted, in writing, to the Energy Commission's Docket Unit, located at 1516 Ninth Street, MS-4, Sacramento, California, 95814-5512, no later than 5:00 p.m. on June 1, 2007. Identify these comments with "Docket No. 06-IEP-01J."
